Terms of Service

1. Purpose of the platform

KiraCars is a marketplace connecting renters and authorized car rental agencies in Tunisia. We do not own any vehicles. Our role is to facilitate search, booking, and secure payment of the rental deposit. The site is accessible at kiracars.com.

2. Acceptance of terms

Use of the KiraCars platform implies full acceptance of these terms of service. If you do not accept these terms, you must not use the platform.

3. Registration and user account

To make a reservation, the client must create an account providing accurate and up-to-date information. The user is responsible for the confidentiality of their credentials. KiraCars reserves the right to suspend any account in case of abuse or fraud.

4. Booking and payment

Booking is done online, but the rental is paid in full, exclusively at the agency, in Tunisian dinars (TND), when picking up the vehicle. The accepted payment method (cash, card...) depends on each agency and is confirmed directly with them before key handover. KiraCars never collects any amount related to the rental.

The displayed amount depends on the pricing model (All-inclusive, Net+, or set per vehicle) chosen by the partner agency, and can be viewed in different currencies for information only — only the TND amount paid at the agency is binding.

The security deposit, if the listing includes one, is never collected by KiraCars: it is handed directly to the agency upon key handover — see Article 12.

5. Cancellation and modification

The client can cancel or modify their reservation up to 48 hours before the departure date, free of charge. Beyond this period, cancellation may be refused by the agency. Since no amount is paid online at the time of booking, no refund is needed for a cancellation made within the deadline.

6. Purpose and registration

KiraCars acts solely as an intermediary connecting agencies with renters. The agency remains solely responsible for the rental service itself (vehicle, insurance, handover/return).

The agency provides its legal name, tax ID and trade register number. KiraCars verifies and validates the account within 48 hours, and may refuse or suspend an account in case of inaccurate information or fraud.

7. Fleet listing

The agency guarantees the accuracy of the information published (vehicles, rates, availability, photos) and keeps it up to date. It manages its calendar to avoid double bookings.

8. Pricing model

The agency freely sets its rates according to the model it chooses: All-inclusive (public price set by the agency, commission deducted from it), Net+ (net price set by the agency, commission added on top), or a model set per vehicle. This choice can be changed for each vehicle.

9. Commission

KiraCars may apply a commission on the amount of each confirmed booking, deducted automatically at settlement. Your agency's commission rate is viewable at any time from your agency dashboard; any change to this rate is notified to you in advance, with its effective date.

Depending on the platform's development phase, KiraCars may disable commission for all agencies: in that case, no commission is deducted on confirmed bookings during that period, regardless of the rate otherwise on file for your agency.

10. Financial flow

The client pays the full rental amount directly to the agency, in Tunisian dinars, upon key handover. The payment method (cash, card...) is determined by the agency and agreed directly with them. KiraCars never collects or pays out any amount related to the rental.

11. Agency obligations

The agency must honor accepted bookings, provide a compliant and insured vehicle, respect the deposit policy displayed on its listings, and comply with Tunisian law.

12. Security deposit

The security deposit, if the listing includes one, is managed according to the terms displayed on the listing (see our Deposit Policy). It is handed directly to the agency (payment method agreed with them), never collected by KiraCars.

13. Customer reviews

The agency accepts the publication of reviews from verified clients who have completed a rental.

14. Referral program

An already registered agency may refer a new agency by sharing its personal referral code, which the new agency enters when registering. When the referred agency reaches a minimum number of published vehicles on the platform, the referring agency receives a non-financial reward (currently, a complimentary professional photo session for its fleet) along with the public "referring agency" status displayed on its page. This program has no time limit and has no effect on either agency's commission rate.

15. Termination

The agency may stop using the platform at any time and withdraw its listings. Bookings already confirmed at that time must still be honored.

16. Liability

KiraCars acts as a technical intermediary; any dispute regarding the performance of the rental is the agency's responsibility. KiraCars may act as a mediator between the parties.

17. Personal data

The data (identity documents, driving licenses, business documents) collected are strictly intended for KiraCars and the partner agency concerned. They are never sold. Under Tunisian law (Law 2004-63, INPDP), you have a right to access, modify, and delete your data. Contact us at contact@kiracars.com.

18. Changes to these terms and applicable law

KiraCars may amend these terms of service; any substantial change is notified to you before it takes effect. These terms are governed by Tunisian law. In case of dispute, Tunisian courts will have exclusive jurisdiction.
